Welcome to Deliivo.
These Terms and Conditions ("Terms") govern your access to and use of the Deliivo platform, website, mobile applications, and related services (collectively, the "Platform").
The Platform is operated by Deliivo Technologies OÜ ("Deliivo", "we", "our", or "us"), Registry Code 17560200, a private limited company incorporated in the Republic of Estonia.
Deliivo currently operates within Estonia, Latvia and Lithuania ("Baltic Region"). Availability of services outside this region is not guaranteed.
By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
1. ABOUT DELIIVO
Deliivo is a digital carpooling platform that enables Drivers and Passengers travelling in the same direction to connect, arrange shared journeys, contribute toward travel costs, and communicate through the Platform.
Deliivo is not:
•a transport operator;
•a taxi company;
•a ridesharing carrier;
•a travel agency; or
•a provider of transportation services.
Deliivo does not own, operate, or control vehicles and does not employ drivers.
Any transportation arrangement is entered into directly between the Driver and Passenger.
2. DEFINITIONS
For the purpose of these Terms:
•Account means a registered user account on the Platform.
•Driver means a user who offers available seats in their vehicle for a Trip.
•Passenger means a user who books a seat on a Driver's Trip.
•Trip means a journey published on the Platform by a Driver.
•Booking means a reservation made by a Passenger for a Trip.
•Contribution means the amount paid by a Passenger toward the shared travel expenses of a Trip.
•Service Fee means any fee charged by Deliivo for use of the Platform.
•User means any person using the Platform.
3. ELIGIBILITY
To use Deliivo, you must:
•be at least 18 years old;
•have legal capacity to enter into binding agreements;
•provide accurate and complete information;
•maintain only one account unless authorized by Deliivo.
Drivers must additionally:
•hold a valid driving licence;
•possess all legally required vehicle documentation;
•maintain legally required insurance coverage;
•comply with all applicable traffic and transportation laws.
Deliivo may request identity documents, driving licence verification, vehicle registration, insurance documentation or other information before allowing certain Platform activities.
4. ACCOUNT REGISTRATION
Users are responsible for:
•maintaining account security;
•protecting login credentials;
•ensuring information remains accurate.
Users must immediately notify Deliivo of unauthorized access or suspected misuse of their account.
Deliivo reserves the right to suspend or terminate accounts that contain false or misleading information.
5. NATURE OF THE SERVICE
Deliivo provides technology that enables Users to connect and arrange shared journeys.
Deliivo does not:
•guarantee that any Trip will occur;
•guarantee Driver or Passenger availability;
•inspect vehicles;
•verify insurance coverage for every Trip;
•supervise or control any transportation activity.
Users are solely responsible for complying with all applicable laws relating to their participation in any Trip.
6. COST-SHARING PRINCIPLE
Deliivo operates as a carpooling and cost-sharing platform.
Drivers may only seek contributions intended to share reasonable travel expenses, including:
•fuel costs;
•toll charges;
•parking fees;
•ordinary vehicle operating expenses.
Drivers may not use Deliivo to:
•operate a taxi service;
•provide commercial passenger transport;
•generate profit from transportation activities.
Deliivo reserves the right to remove Trips or suspend accounts suspected of operating as commercial transportation services.
7. DRIVER RESPONSIBILITIES
Drivers agree to:
•provide accurate Trip details;
•arrive at agreed locations and times;
•maintain valid driving privileges;
•maintain legally required insurance;
•ensure vehicle roadworthiness;
•provide available seatbelts for all passengers;
•comply with applicable laws.
Drivers remain solely responsible for the operation of their vehicles.
8. PASSENGER RESPONSIBILITIES
Passengers agree to:
•provide accurate information;
•arrive at agreed pickup locations on time;
•respect Drivers and fellow Passengers;
•comply with vehicle rules communicated by Drivers;
•pay applicable Contributions and Service Fees.
Passengers remain responsible for their personal belongings throughout a Trip.
9. BOOKINGS AND PAYMENTS
Deliivo may facilitate payments through third-party payment providers.
By making a Booking, a Passenger agrees to:
•pay the Contribution amount;
•pay any applicable Service Fees;
•comply with booking conditions established through the Platform.
Payment processing services may be provided by licensed payment institutions operating within the European Economic Area.
Deliivo does not guarantee uninterrupted payment services.
10. CANCELLATIONS
Bookings and Trips may be cancelled subject to the Deliivo Cancellation Policy.
Repeated cancellations may result in:
•reduced visibility;
•account restrictions;
•suspension or termination.
Deliivo reserves the right to establish and modify cancellation rules.
10.1 Refunds and Booking Adjustments
Refund eligibility may depend on the timing of cancellation, payment status, and circumstances of the Trip.
Deliivo may establish additional operational rules covering:
•Driver cancellations
•Passenger cancellations
•No-show situations
•Refund processing
•Payment disputes
Where applicable, refunds shall be processed through the designated payment provider.
11. RATINGS AND REVIEWS
Drivers and Passengers may submit reviews following completed Trips.
Reviews must:
•be truthful;
•be relevant to the Trip;
•not contain offensive, abusive, discriminatory, or unlawful content.
Deliivo may remove reviews that violate these Terms.
12. PROHIBITED CONDUCT
Users must not:
•provide false information;
•impersonate another person;
•engage in fraud;
•harass or threaten others;
•discriminate against others;
•promote illegal activities;
•use the Platform for commercial transportation services;
•attempt to interfere with Platform operations.
Violations may result in immediate suspension or termination.
13. USER CONTENT
Users retain ownership of content they upload, including:
•profile information;
•photographs;
•reviews;
•messages.
By uploading content, Users grant Deliivo a non-exclusive, worldwide licence to use, display, reproduce, and distribute such content for the operation and promotion of the Platform.
14. PRIVACY
Deliivo processes personal data in accordance with its Privacy Policy and applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679 ("GDPR").
Users should review the Privacy Policy for detailed information regarding data processing activities.
15. ACCOUNT SUSPENSION AND TERMINATION
Deliivo may suspend or terminate any Account if it reasonably believes that a User:
•violated these Terms;
•engaged in fraudulent activity;
•created safety risks;
•provided false information;
•used the Platform unlawfully.
Deliivo may remove content or Trips without prior notice when necessary to protect Users or comply with legal obligations.
16. LIABILITY DISCLAIMER
To the maximum extent permitted by applicable law:
Deliivo is not responsible for:
•transportation services;
•road accidents;
•injuries;
•property damage;
•delays;
•missed connections;
•conduct of Drivers or Passengers.
Users acknowledge that participation in any Trip occurs at their own risk.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
17. INDEMNIFICATION
Users agree to indemnify and hold harmless Deliivo, its directors, employees, and affiliates from claims, damages, losses, liabilities, and expenses arising from:
•their use of the Platform;
•their violation of these Terms;
•their conduct during Trips.
18. DIGITAL SERVICES ACT COMPLIANCE
Users may report illegal content, unlawful activity, or safety concerns through Deliivo's reporting mechanisms.
Deliivo may investigate reports and take appropriate action, including content removal, account restrictions, or referral to competent authorities.
19. CHANGES TO THE TERMS
Deliivo may update these Terms from time to time.
Where legally required, Users will be notified of material changes before they become effective.
Continued use of the Platform constitutes acceptance of the updated Terms.
20. GOVERNING LAW
Any dispute arising out of or relating to these Terms shall be subject to the laws of the Republic of Estonia.
However, nothing in these Terms limits any mandatory consumer protection rights available to Users under applicable European Union laws or other applicable local consumer protection legislation.
21. SAFETY
Users acknowledge that Deliivo does not conduct criminal background checks on all Users unless expressly stated.
Users should exercise reasonable judgment before participating in any Trip.
Emergency services should be contacted directly in case of immediate danger.
22. FORCE MAJEURE
Deliivo shall not be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, war, governmental actions, internet failures, power outages, or third-party service disruptions.
23. INTELLECTUAL PROPERTY
All Platform software, trademarks, logos, graphics, text, databases and other intellectual property remain the exclusive property of Deliivo Technologies OÜ unless otherwise stated.
24. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
